PERSONAL DATA AND COOKIES

Enight respects the privacy concerns of users regarding confidentiality of personal information provided.

Enight ensures conformity with the obligations related to the CNIL.

As data controller under the Data Protection Act of 6 January 1978 amended in 2004 and the European Directive of 24 October 1995 (hereinafter, the “Data Protection Act”) Enight may collect personal data (surnames, forenames, contact information…) or non personal information (preferences, favourite information…) when users visits their website (hereinafter the “Site”) so as to be able to identify them, to offer them personalised services or to improve the Site and to listen to them.

1 – RECIPIENTS OF THE DATA COLLECTED

Enight is the recipient of the data.
In any event, Enight will only disclose users’ personal data to third parties when:

  • the user has given prior consent to sharing of this information,
  • Enight has to share this information with third parties to provide the expected service,
  • Enight wants to give the user the benefit of partner’s offers,
  • Enight is required by a judicial or other administrative authority to provide the information.

Enight may also disclose users’ personal data to third party providers for statistical studies of the use of the Site and for Site optimization purposes. In this context, users’ personal data will be anonymous.

2 – PURPOSES OF DATA COLLECTION

Throughout the Site, Enight collects user data that is strictly necessary for the following purposes:

  • provision and personalization of the Site
  • management of newsletter subscriptions (subscriptions and unsubscriptions),
  • Enight’s commercial and promotional offers.

Enight undertakes to process and store any personal information entrusted by the user in compliance with the provisions of the Data Protection Act and this only to keep users informed of Enight news and to ensure that they take priority advantage of offers of goods and services related to Enight’s activity.

3 – DATA RETENTION AND SECURITY

The data shall be kept for no longer than is necessary for the purposes for which they were collected:

for newsletter subscription management, data will be kept as long as the subscription is active and all data will be deleted within 2 months of a user’s unsubscription;

Other data will be kept for a period of 2 years.

Enight has endeavoured to take all necessary precautions to preserve the confidentiality and security of the personal data processed and to prevent them from being distorted, damaged, destroyed or accessed by unauthorised third parties.

State-of-the-art technical and organisational security measures, in particular with regard to information systems, have been introduced.

However, Enight does not control all risks associated with the operation of the Internet and draws users’ attention to possible risks inherent in its use and operation.

4 – USERS’ RIGHTS

Users are informed that they have, in accordance with the Data Protection Act, at any time a right to access, update, rectify and delete their personal data by sending a request (indicating precisely the subject of their request) via the Internet to the following address :

Users are informed that they have, in accordance with the Data Protection Act, at any time a right to object, for legitimate reasons, to the processing of personal data concerning them.

5 – COOKIES, NAVIGATION AND LOCATION DATA

When accessing the Site, and after acceptance of continued browsing by users, a cookie may be installed and stored for a maximum of 13 months in memory or on the user’s hard drive to facilitate browsing. A cookie does not make identification possible but is an element which is used to record information relating to Site navigation (pages consulted, date and time of consultation, etc.)

Cookies issued:

  • facilitate the browsing experience on the Site, so as to improve the interest and ergonomics of the services consulted on the Site, and adapt the Site;
  • store information relating to a form that the user has completed on the Site (registration or access to the account) or to products chosen on the Site (content of an order basket, etc.);
